Thankfully they didn&#8217;t; the Schiavo law was the beginning of the Bush administration&#8217;s loss of mainstream, independent American voters.<br \/>\nThe NSA wiretapping story feels to me like a similar moment. Will the American people buy the <a href=\"http:\/\/digbysblog.blogspot.com\/2005_12_11_digbysblog_archive.html#113477714899464334\">John Yoo theory<\/a> that anything the president does with a national security justification is by definition legal?  Or will they agree with Russ Feingold that &#8220;The President does not get to pick and choose which laws he wants to follow. He is a president, <a href=\"http:\/\/rawstory.com\/news\/2005\/Democratic_senator_says_Bush_violated_law_1217.html\">not a king.&#8221;<\/a><br \/>\nUpdate:<br \/>\n* <a href=\"http:\/\/glenngreenwald.blogspot.com\/2005\/12\/purposely-misquoting-fisa-to-defend.html\">this reading of FISA<\/a> indicates that the surveillance should have required FISA warrants.<br \/>\n* comments <a href=\"http:\/\/ezraklein.typepad.com\/blog\/2005\/12\/talking_point_d.html#comments\">here<\/a> raise questions about whether the surveillance should have been covered<br \/>\n* more facts are needed.
